The my-pro website and any associated mobile application (the Site) is owned and operated by My-Pro Limited, a company registered in England and Wales with registered number 07007636 and with its registered office at 11 Broad Walk, Cranleigh, GU6 7LS (we, us). By using my-pro, you agree to be bound by this privacy & cookie policy (the Privacy & Cookie Policy). This Privacy & Cookie Policy affects your legal rights and obligations so please read it carefully. If you do not agree to be bound by this Privacy & Cookie Policy, do not use my-pro or provide us with any personal data. If you have any questions, you can contact us at enquiries@my-pro.eu.

We reserve the right to update this Privacy & Cookie Policy from time to time at our discretion. If we do so, and the changes substantially affect your rights or obligations, we shall notify all registered users through their my-pro account. Otherwise you are responsible for regularly reviewing this Privacy & Cookie Policy so that you are aware of any changes to it. The updated version will be effective as soon as it is accessible.

This Privacy & Cookie Policy applies to all users of my-pro, including PGA Club Professionals, players and to anyone else who provides information to us.

We are the data controller of your personal data.

Collecting Your Data

2.1

"Personal data" is information that identifies you as an individual, such as name, photograph and email address. All personal data that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal data. You must not register under someone else’s name. You must keep your log-in details confidential. You are responsible for all activity under your my-pro account.

2.2

In order to register as a PGA Club Professional, you must provide us with your name, email address, golf club attachment, county/dependency/state/province and country of location, which PGA you are a member of and your PGA membership number. You can then add further personal data to your profile on the Site, including a profile picture, your date of birth, place of birth, when you became a professional, your position within your business, and a contact telephone number together with a brief biography and details about the golf clubs you use, your playing record and any sponsors you have.

2.3

In order to register as a player, you must provide us with your name, email address, county/dependency/state/province and country of location, gender, whether you are a member of the club where the PGA Professional is located, whether you are left or right handed and details about your golf handicap. On registration, you must add details of the golf clubs that you use, assess your performance with each club and set a performance objective. You may also add scorecards to update your on-course analysis data.

2.4

As a PGA Club Professional you may choose to provide us with the email address of a friend, contact or other individual who you believe may wish to join my-pro. If you do so, you must first obtain the consent of the individual. We shall then send an email to the individual on your behalf explaining that you provided their email address to us so that we could contact them and invite them to join my-pro.

3.

Data we automatically collect

3.1

When you use the my-pro system, we automatically collect and store information about your device and your activities. This information could include (a) your computer or other device's unique ID number; (b) your mobile device's geographic location; (c) your IP address: (d) technical information about your device such as type of device, web browser or operating system; (e) your preferences and settings such as time zone and language; (f) how long you used the system and which services and features you used including referring and exit pages and number of clicks. We collect this information using cookies in accordance with the Cookie section of this Privacy & Cookie Policy and we use the information we collect on an anonymous basis to personalise user experience. It also allows us to display relevant content, services and promotional material to the appropriate audience. This information is not linked to your personal data

3.2

We may also use anonymous information in the aggregate to understand how our users as a group use the services and resources provided on our site and we may share that information with our suppliers and partner organisations.

Use of your personal data

4.1

We will process your personal data to perform our obligations under the Terms of Use. This means that if you are a registered golf professional, you understand and agree that all users of the Site can view your profile on my-pro. Likewise, if you are a registered player, you understand and agree that any golf professional that is linked to your account can view your profile. We will use your email address to identify you when you sign into your profile following registration and to contact you to confirm creation of your profile following registration. We shall also send you email notifications when there are updates within your profile made either by any golf professional that is linked to your account or by my-pro. External notifications may be disabled at any time within your profile. We will also use your data to respond to any enquiries, questions or other requests made by any individual who contacts us.

4.2

For our legitimate interests, we may share your personal data with any service providers, sub-contractors and agents that we may appoint to perform functions on our behalf and in accordance with our instructions, including IT service providers, accountants, auditors and lawyers. We shall provide our service providers, sub-contractors and agents only with such of your personal data as they need to provide the service for us and if we stop using their services, we shall request that they delete your personal data or make it anonymous within their systems.

4.3

In order to comply with our legal obligations, under certain circumstances we may have to disclose your personal data under applicable laws and/or regulations, for example, as part of anti-money laundering processes or protect a third party's rights, property, or safety.

4.4

For our legitimate interests, we may also share your personal data in connection with, or during negotiations of, any merger, sale of assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

Marketing

5.1

From time to time, marketing messages may appear in your my-pro account, but we will not send marketing emails to you.

Where we hold and process your personal data

6.1

We will not store or transfer your personal data outside of the European Economic Area without your consent.

Cookies

7.1

We use cookies on this site to better your experience when you visit us. Cookies are small files saved on your computer's hard drive that track, save and store information about your interactions and usage of a website. There are two types of cookie. A "persistent" cookie will remain valid until its set expiry date unless it is deleted by the user before the expiry date. A "session" cookie will expire at the end of the user session, when the web browser is closed.

7.2

We use "persistent" cookies so that we may provide you with a tailored experience every time you visit us.

7.3

Our website does have partner links and therefore non my-pro cookies may be stored on your computer if and when you visit our partners. When you visit a partner no personal identifiable information is stored, saved or collected by them unless you voluntarily submit this detail.

7.4

If you wish to deny the use and saving of cookies from this website on to your computer's hard drive you should take the necessary steps within your web browsers security settings to block all cookies from this website and its external serving partners.

7.5

We also use my-pro Analytics to monitor how the my-pro website is used. my-pro Analytics collects information anonymously and generates reports detailing information such as the number of visits to the system, where visitors generally came from, how long they stayed on the system, and which pages they visited. my-pro Analytics does not place persistent cookies on your computer's hard drive.

8.

Security

8.1

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorised access, alteration, disclosure or destruction of your Personal Identifiable Information and data stored on our site. Private data exchange between the site and its user happens over a SSL secured communication channel and is encrypted and protected with digital signatures. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise that your personal data or other content that you upload to the system will always remain secure.

Advertising

9.1

Our objective at my-pro is to keep our site free from excessive and inappropriate advertising. With this in mind our site "Sponsor" and "Partners" will only be able to communicate with our users through relevant functions within the site.

9.2

The majority of our "Partners" are leading manufacturers operating within the golf industry. Our site "Sponsor" may operate outside of the golf industry. Where appropriate we will provide links to their websites should our users wish to learn more about their products and activities.

9.3

We do not control the content or links that appear on our "Partners" websites and are not responsible for the practices employed by them. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our site, is subject to that website's own terms and policies.

10.

Your rights

10.1

my-pro offers a "Profile" page where you can update your personal details at any time including your full name, email address and optional profile picture. When you are logged in to your profile you can access and edit your personal details from all pages on the site by simply going to your name in the top right hand corner of the screen and selecting "Profile" in the drop down menu.

10.2

You have the right to obtain from us a copy of the personal data that we hold for you, and to require us to correct errors in the personal data that we process for you if it is inaccurate or incomplete. You also have the right at any time to require that we delete your personal data. To exercise these rights, or any other rights you may have under applicable laws, please contact us at enquiries@my-pro.eu.

10.3

Please note, we reserve the right to charge an administrative fee if your request is manifestly unfounded or excessive.

If you have any complaints in relation to this Privacy & Cookie Policy or otherwise in relation to our processing of your personal data, please contact us, or you can contact the Information Commissioner, see www.ico.org.uk. If you are outside of the UK, you have the right to lodge your complaint with the relevant data protection regulator in your country of residence.

10.5

We retain your personal data in accordance with applicable laws. Therefore, if you register with us, we shall retain your personal data until you close your account except where we are required to retain your personal data for longer to comply with accounting and taxation requirements. If you receive marketing communications from us, we shall retain your personal data until you opt out of receiving such communications. If you have otherwise contacted us with a question or comment, we shall retain your personal data for 6 months following such contact to respond to any further queries you might have.

General

11.1

If any provision of this Privacy & Cookie Policy is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.

11.2

This Privacy & Cookie Policy shall be governed by and construed in accordance with the law of England and Wales, and you agree to submit to the exclusive jurisdiction of the English Courts.
